{"id":981,"date":"2018-09-25T15:36:13","date_gmt":"2018-09-25T15:36:13","guid":{"rendered":"http:\/\/blog.valdosta.edu\/research\/?p=981"},"modified":"2018-09-25T15:36:13","modified_gmt":"2018-09-25T15:36:13","slug":"harassment-sexual-and-or-gender-misconduct-and-funding-tips-for-award-management-in-critical-times","status":"publish","type":"post","link":"https:\/\/blog.valdosta.edu\/research\/2018\/09\/25\/harassment-sexual-and-or-gender-misconduct-and-funding-tips-for-award-management-in-critical-times\/","title":{"rendered":"Harassment, Sexual and\/or Gender Misconduct and Funding: Tips for Award Management in Critical Times"},"content":{"rendered":"<p><em>by The Grants Resource Center,\u00a0\u00a0<a href=\"mailto:grantweek@aascu.org\">Fatoyinbo, Willette B.<\/a><\/em><\/p>\n<div class=\"ExternalClassB6BBD177E6A34642935162D4FE5F86D6\">\n<p>Your institution witnesses an uptick in research support and then a sudden wave of gossip, conflict and bad press\u00a0hits your campus about\u00a0harassment allegations in the lab.<\/p>\n<p>Your office is forced to ask the difficult question:\u00a0<em>How do we manage an award led by\u00a0a principal investigator (PI) accused of sexual and\/or gender misconduct?<\/em><\/p>\n<p>The\u00a0<a href=\"https:\/\/www.nih.gov\/\">National Institutes of Health<\/a>\u00a0(NIH) takes\u00a0sexual misconduct\u00a0<a href=\"https:\/\/www.nih.gov\/anti-sexual-harassment\">seriously<\/a>\u00a0and has voiced concern\u00a0about sexual misconduct in the lab.\u00a0This month, NIH\u00a0released an\u00a0<a href=\"https:\/\/grants.nih.gov\/grants\/guide\/notice-files\/NOT-OD-18-172.html\">approval policy<\/a>\u00a0(<span class=\"noticenum\">NOT-OD-18-172)\u00a0<\/span>outlining circumstances that may negatively affect a PI&#8217;s or other key personnel&#8217;s ability to conduct sufficient research. Additionally, in the case that NIH learns about\u00a0an awardee who is not enforcing the terms and conditions of award, the agency notes, &#8220;NIH may take an\u00a0<a href=\"https:\/\/www.nih.gov\/anti-sexual-harassment\/frequently-asked-questions#question-two\">enforcement action\u00a0<\/a>within our oversight authorities, which may include suspending or even terminating the grant.&#8221;<\/p>\n<p>Despite\u00a0one&#8217;s personal\u00a0stance&#8211; on the issue of harassment, sexual and\/or gender misconduct&#8211;, it is important to stay abreast of social change and\u00a0monitor how shifts in policy directly impact your office&#8217;s ability to stay in compliance.\u00a0Here are three simple best practices to help your office\u00a0navigate through changing the status of a researcher during\u00a0times of crisis:<\/p>\n<p>1.\u00a0<strong>Proactively communicate.\u00a0<\/strong>NIH requires the grantee (typically the institution, not an individual)\u00a0to notify NIH and seek advance approval for replacement(s) of PIs and\/or other senior\/key personnel. NIH does not prescribe a timeframe, however, not all federal agencies\u00a0are alike. A recent National Science Foundation (NSF)\u00a0<a href=\"https:\/\/www.nsf.gov\/news\/news_summ.jsp?cntn_id=296610\">harassment policy<\/a>\u00a0 paints a clear\u00a0example of proactive communication with a time sensitive requirement.<\/p>\n<p><strong>\u200b2. Revisit your commitments.\u00a0<\/strong>As a term and condition of a NIH award, PIs have an Assurance of Compliance with the statutes described in the \u201cCivil Rights Protections\u201d on file. The document enforces federal civil rights laws and provides resources to agencies and grantees that\u00a0address potential violations. In addition, review internal policies and procedures to ensure your office decision making processes align with funder recommendations and institutional protocol.<\/p>\n<p><strong>3. Breathe.\u00a0<\/strong>After the initial shock has passed, take a deep breath and know you are not alone. NIH continues to\u00a0<a href=\"https:\/\/www.edi.nih.gov\/sites\/default\/files\/public\/EDI_Public_files\/sexual-harassment-statement-2017.pdf\">actively<\/a>\u00a0monitor, report\u00a0and help reduce\u00a0sexual and gender harassment in extramural research. The agency is committed to uphold \u201chigh ethical, health, and safety standards in both the conduct of the research we fund and the expenditure of public funds by our recipients,\u201d including adherence to\u00a0<a href=\"https:\/\/grants.nih.gov\/grants\/policy\/nihgps\/HTML5\/section_4\/4.1_public_policy_requirements_and_objectives.htm?Highlight=misconduct#Civil\">civil rights assurances.<\/a><\/p>\n<p>If you would like to discuss this topic offline, feel free to\u00a0contact\u00a0Willette\u00a0B.
